Terms of Service

These Terms of Service ("Terms") govern your access to and use of DealerHailRepair.com (the "Site") and any related services, communications, or programs offered by Dealer Hail Repair ("DHR," "we," "us," or "our"). By using the Site, requesting a walkthrough, submitting any form, opting in to text messages, or otherwise engaging with us, you agree to these Terms.

If you do not agree to these Terms, do not use the Site or our services.

1. About DHR

Dealer Hail Repair is a dealer-exclusive hail growth platform. Our services are designed for and offered to automotive dealerships and dealership groups. Nothing on this Site constitutes an offer of services to the general public, vehicle owners, or non-dealership customers, except where a dealership has enrolled in our Dealer Hail Revenue Program and a vehicle owner is being served under that partnership.

2. Eligibility

You may use the Site only if you are at least 18 years old and legally capable of entering into binding agreements. By using the Site, you represent that you meet these requirements.

If you are using the Site on behalf of a business entity, you represent that you are authorized to bind that entity to these Terms.

3. Services Offered

DHR offers three principal services, each with its own program-specific terms communicated at the time of engagement:

• The Dealer Hail Revenue Program — a long-term partnership relationship that supports dealership-branded customer outreach, claim management, and revenue capture following storm events.
• Storm Response Program — per-event recovery services for dealership-owned inventory damaged in a hail event.
• Supplement Program — per-claim recovery services for previously closed and underpaid dealership hail claims.

The descriptions of these services on the Site are summary descriptions for informational purposes. Specific service terms, deliverables, pricing, and obligations are governed by separate signed agreements between DHR and the dealership.

4. No Insurance Brokerage or Legal Advice

DHR is not an insurance company, insurance broker, or insurance adjuster. We are not your attorney, and nothing on the Site or in our communications constitutes legal advice. We assist dealerships in pursuing and recovering insurance claim amounts they are entitled to under their existing policies. We do not sell insurance products. We do not represent insurance carriers. Consult a licensed attorney or insurance professional for legal or insurance advice specific to your situation.

5. Use of the Site

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the Site. You agree not to:

• Use the Site in any way that violates applicable law
• Impersonate any person or entity or misrepresent your affiliation
• Submit false or misleading information through any form on the Site
• Attempt to gain unauthorized access to any portion of the Site, our systems, or other users' accounts
• Use automated tools (bots, scrapers, crawlers) to access, copy, or harvest content from the Site
• Interfere with or disrupt the Site's operation or security
• Use the Site to transmit viruses, malware, or other harmful code

6. Intellectual Property

All content on the Site — including text, graphics, logos, images, video, audio, code, design elements, branding, the "DHR" name, the "Dealer Hail Repair" name, and any associated taglines and slogans — is owned by DHR or its licensors and is protected by U.S. and international intellectual property laws.

You may view and access the Site for your personal, non-commercial information. You may not copy, reproduce, distribute, publish, modify, sell, or create derivative works from any Site content without our prior written consent.

7. SMS and Text Message Terms

By providing your phone number and opting in to text messages from DHR, you agree to the following:

• You may receive recurring text messages from DHR related to your inquiry, our partnership, scheduling, claim updates, and related business communications.
• Message frequency varies based on engagement.
• Message and data rates may apply per your wireless carrier's plan.
• You may opt out at any time by replying STOP to any text message. After opting out, you will receive one final confirmation message and no further recurring or marketing messages.

• Mobile carriers are not liable for delayed or undelivered messages.
• Consent to receive text messages is not a condition of any purchase or service.

8. Forms, Inquiries, and Lead Submissions

When you submit a form on the Site (including walkthrough requests, calculator submissions, brochure downloads, or contact forms), you agree that:

• The information you provide is accurate and provided voluntarily
• DHR may contact you by phone, email, and (where you have opted in) text message in response to your submission
• Information you submit will be handled in accordance with our Privacy Policy

9. Revenue Projections and Financial Estimates

Any revenue projections, opportunity estimates, financial scenarios, or calculator outputs shown on the Site or generated in response to your inputs are illustrative estimates only. They are based on industry assumptions, the inputs you provide, and our methodology. Actual results vary substantially based on storm activity, dealership database quality, customer behavior, market conditions, and many other factors. DHR makes no representation, warranty, or guarantee that the projected results will be achieved.

10. Third-Party Services and Links

The Site may link to or integrate with third-party services (for example, messaging providers, calendar booking systems, analytics platforms). DHR is not responsible for the content, accuracy, availability, or practices of third-party services. Your use of any third-party service is governed by that service's own terms and policies.

11. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

DHR DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY CONTENT ON THE SITE. ANY RELIANCE YOU PLACE ON SITE CONTENT IS STRICTLY AT YOUR OWN RISK.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DHR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST REVENUE, LOST BUSINESS OPPORTUNITY, OR LOST DATA — ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR OUR SERVICES, EVEN IF DHR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SITE OR ANY INFORMATIONAL CONTENT (SEPARATE FROM SIGNED SERVICE AGREEMENTS WITH DEALERSHIPS) SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this section may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless DHR and its officers, directors, employees, agents, and affiliates from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Site
• Your violation of these Terms
• Your violation of any applicable law or the rights of any third party
• Information you submit through the Site

14. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Tarrant County, Texas, and you consent to the personal jurisdiction of those courts.

15. Dispute Resolution

Before initiating any formal legal action, you agree to first attempt to resolve any dispute informally by contacting us at info@dealerhailrepair.com. We will attempt to resolve the matter within thirty (30) days of receiving your written notice.

16. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top reflects the most recent version. Material changes will be communicated through the Site or by direct notice where appropriate. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms — together with our Privacy Policy and any signed service agreements between DHR and a dealership — constitute the entire agreement between you and DHR regarding your use of the Site.
